This document is an electronic record in terms of the Information Technology Act, 2000 and rules thereunder as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. 1.1 The Agreement: These Independent Driver Terms of Service ("Terms") govern your registration, access, and usage of the mobile application platform widely known by its consumer brand name "Cravioo" (the "App" or "Platform"), which is owned, operated, and maintained by DIGITAL ENGINEERING AND TECHNOLOGIES PRIVATE LIMITED (hereinafter referred to as the "Company", "we", "us", or "our").
1.2 Click-Wrap Binding: By downloading the App, checking the "I Agree" box, or by logging online to accept delivery tasks, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately log offline and delete the App.
1.3 Marketplace Marketplace Only: The Company operates strictly as an online technology intermediary platform. The App provides a digital interface that matches independent vehicle operators (like you) with consumers and merchants who require local logistics and delivery fulfillment services.
2.1 No Employment Relationship: You explicitly acknowledge and agree that using the Platform does not establish an employer-employee relationship, labor contract, joint venture, or agency between you and the Company or any of its localized zonal partners.
2.2 Absolute Schedule Flexibility: You operate entirely as an independent freelance gig-worker. You retain the absolute right to choose your own hours, log online or offline whenever you want, and accept or reject any delivery task routed to your device screen.
2.3 Exclusion of Benefits: Because you are an independent freelancer, you are not entitled to, nor shall you claim, any corporate employee benefits from the Company, including but not limited to minimum wage guarantees, provident fund (PF), employee state insurance (ESI), gratuity, corporate bonuses, or paid leave.
By submitting your application and accessing the App interface, you warrant that you continuously maintain the following criteria:
3.1 Age Requirement: You are at least 18 years of age and hold the full physical and legal capacity to operate a transport vehicle safely on public roads.
3.2 Active Statutory Documents: You must upload clear, unedited photographs of the following valid documents issued by Indian regional transport authorities before your account can be approved:
3.3 Operational Maintenance: You are solely responsible for providing, fueling, maintaining, and repairing the vehicle you choose to use. The Company bears zero financial responsibility for your vehicle depreciation, fuel costs, toll taxes, parking fees, or traffic maintenance bills.
4.1 Compliance with Traffic Laws: You shall strictly obey all traffic signals, speed limits, helmet/seatbelt mandates, and local municipal traffic regulations while executing an active delivery run.
4.2 Zero Alcohol/Substance Policy: You are strictly prohibited from logging online or executing deliveries while under the influence of alcohol, narcotics, or any intoxicating substances. A violation of this clause will trigger an immediate, permanent ban from the Platform.
4.3 Total Accident Indemnification: You explicitly agree that the Company and its individual software creators bear zero financial, civil, or criminal liability if you get into a road traffic accident, suffer bodily injury, or cause injury, property damage, or death to any third party while logged online. You operate your vehicle entirely at your own risk and must rely on your personal vehicle insurance to cover any operational damages or legal claims.
5.1 Ecosystem Delivery Handling: You must collect packaged items from pickup counters and immediately place them inside a clean, closed container or vehicle boot space. You shall not open, tamper with, sample, or alter any sealed customer packaging under any circumstances.
5.2 Strict Customer Privacy: You will be granted temporary view-access to limited customer details (such as the customer's first name, localized neighborhood drop-off point, and delivery notes) strictly to execute the assigned task. You are strictly prohibited from copying, screenshotting, saving, or sharing customer phone numbers or private address details with anyone else.
5.3 Post-Delivery Masking: Once a task is marked as "Delivered" on the app interface, your right to access the customer's details automatically expires. You shall never contact a customer, visit their home, or send text messages via personal phone numbers after the delivery has been completed. Any unauthorized contact constitutes a criminal privacy breach and will result in an immediate permanent account ban and legal escalation.
6.1 Fee Structure: In consideration for successful delivery fulfillment, you will be paid a freelance delivery fee per completed order. This fee is calculated dynamically based on distance traveled, weather conditions, surge times, and neighborhood zone matrices.
6.2 Payout Cycle: Your accrued earnings shall be transferred digitally directly to your verified personal bank account or linked UPI ID on a weekly basis, after deducting any applicable statutory taxes (such as Tax Deducted at Source - TDS) under Indian Income Tax regulations.
6.3 Deductions for Fraud: The Company reserves the right to deduct fees or withhold weekly payouts if our backend system detects fraudulent patterns, such as marking an order as "Delivered" when it was physically stolen or abandoned.
7.1 Termination for Convenience: Either party may terminate this freelance relationship at any time without cause by simply logging off or deleting the App.
7.2 Immediate Block for Cause: The Company reserves the absolute right to permanently deactivate and shadow-ban your account instantly and without notice if you:
8.1 Jurisdiction: This Agreement shall be governed by and interpreted exclusively in accordance with the laws of the Republic of India. Any disputes, claims, or legal proceedings arising out of this freelance logistics arrangement shall be subject to the exclusive jurisdiction of the courts located in [Insert Your City/State], India.
By proceeding with delivery partner registration on the Cravioo platform, you acknowledge that you have read, understood, and agree to be legally bound by all terms and conditions outlined in these Independent Driver Terms of Service.
